Terms of services

By commissioning me, the client (you) agrees to the following terms and conditions:BEFORE START
- The client is responsible for providing clear and accurate image references and/or textual references. I require fully completed materials before assessing a project.
- I reserve the right to refuse or cancel and refund an order at any time, at any stage or point of the terms.
- By commissioning me, the client agrees to provide necessary information to assist the completion of their project. This includes, but is not limited to: name (as it appear on your PayPal account), email, social media username.
- Data collected will not be stored nor accessible for anyone than me and is used solely for the processing and completion of the client’s project.
- The client is responsible for ensuring that the artwork obeys the platform's terms of service. I take no responsibility for projects rejected by any other service or organization.
- The client agrees they are of legal age.
- I retain all copyright over my work.WORK IN PROGRESS
- Estimate time to finish the commission its around 4 to 8 weeks from when the work started, unless stated by me.
- Depending on the progress, you will get updates a minimum of 1 a week once the project has started.
- Each phase, you will be allowed to do 2 small revisions, more than that will be charged as an extra.
- I will wait 4 days for you to respond with feedback of the progress, if the client fails to respond to feedback/revision, I will continue without the client’s feedback. I am not responsible for any unsatisfactory element of the finished project if there was no feedback.
- Testing and polishing the completed model will be a joint effort between me and client, this is to detect any minor errors. If the clients fail to respond within 4 days, it will be delivered without revisions and any feedback after this will be charged.
- I reserve the right to publicly display commissioned artwork in any way I wish (this include, but it is not limited to upload a recording and livestream), at any stage, even when it’s finished already. If the client wishes for a commission to be kept private until a certain time, they must state such when ordering, this has an extra price (+15%).PAYMENT
- No refunds. In the case that I must cancel an order (without the drawing or animation having started), the client will be fully refunded for any unfinished work. The client agrees not to file a chargeback without first contacting me.
- All payments must be made through invoices provided by me via PayPal, will only accept USD (the client has to make the currency conversions). I will not start the project until the 50% of the price has been fully pre-paid for. If you are from Chile, you can choose “Mach” to pay for the project (1 USD = 800 CLP).
- First payment must be received upon delivery of the invoice within 10 days. If payment is not received, I reserve the right to cancel the project.
- For Live2D model art, the remaining 50% is due upon sketch approval; for Live2D rigging, the remaining 50% is due upon head completion; and for any other projects, the remaining 50% is due upon sketch approval. If the project contains both types of work, the first charge will be 50% of the total and the remaining upon animation approval.
- If the client fails to make additional payments within 10 days of first due completion (or any stage completion), I reserve the right to cancel the project without refund.DISCLAIMER
- All of my sales are “Digital Artworks”, and you purchased the “Artwork Intellectual Property”.
- Nothing is ever intended to be physically shipped to the client.
- I'm not responsible for copyright problems of the character if the client uses references of other already existing ones.FINISHED PROJECT
- The client must not reproduce or distribute commissioned artwork for any other purpose than personal use (you can use it on streams, content in Youtube or any other stream platform). To inquire about work for commercial use, please email me directly at [email protected].
- The client must appropriately credit me with the project on all social media and streaming platforms where the project deliverables are used, you can look for my social media on this site (you can just one of them).
- Generally, models are not permitted to be edited or updated by other modelers. I will try to prioritize requests from existing clients, but be aware that availability is not always guaranteed.
- The client or any other person must not edit, trace, distribute, modify, or claim/credit the commissioned project as their own. You CAN edit the colors of your model with Vtube Studio.
- Upon final project delivery, I will keep the project ticket open for a week for final revisions, this through private messages. Revision requests made after this period will be considered an “upgrade” project and will be processed and scheduled as such.
- I will provide preferred credits to the client upon project completion.
- The client is responsible for saving any information given by me. I try to preserve the final piece up to 3 months, however I cannot guarantee that.
- For artworks I reserve the right to remain my signature on it.OTHER
- My work hours are Monday to Friday (9:00 to 21:00 CL).
- I give no permission to use AI generated images (or anything related to AI), NFT's and more with my art or anything related to me.
- I may revise these Terms from time to time at any point and change them, if these changes have any project on going, I will contact you to update the terms. The client agrees to be bound by the revised Terms and Conditions.

Términos y condiciones

Al comisionarme, el cliente (usted) acepta los siguientes términos y condiciones:ANTES DE COMENZAR
- El cliente es responsable de proporcionar referencias de imágenes y/o textuales claras y precisas. Requiero de materiales completos antes de evaluar un proyecto.
- Me reservo el derecho de rechazar o cancelar y reembolsar un pedido en cualquier momento, en cualquier etapa o punto de los términos.
- Al comisionarme, el cliente se compromete a proporcionar la información necesaria para ayudar a la realización de su proyecto. Esto incluye, pero no se limita a: nombre (como aparece en su cuenta de PayPal), correo electrónico, nombre de usuario en redes sociales.
- Los datos recopilados no serán almacenados ni serán accesibles por terceros, se utilizarán únicamente para el procesamiento y finalización del proyecto del cliente.
- El cliente es responsable de asegurarse de que el proyecto cumpla con los términos de servicio de la plataforma en que se utilice. No me hago responsable de los proyectos rechazados por cualquier otro servicio u organización.
- El cliente declara que es mayor de edad.
- Retengo todos los derechos de autor sobre mi trabajo.TRABAJO EN PROGRESO
- El tiempo estimado para terminar la comisión es alrededor de 4 a 8 semanas desde que comenzó el trabajo, a menos que yo indique otra cosa.
- Dependiendo del progreso, recibirá un mínimo de 1 actualización por semana una vez que el proyecto haya comenzado.
- En cada fase, se le permitirá hacer 2 pequeñas revisiones, más de eso se cobrará como un extra.
- Esperaré 4 días para que responda con la retroalimentación del progreso, si el cliente no responde a la retroalimentación/revisión, continuaré sin esta. No soy responsable de ningún elemento insatisfactorio del proyecto terminado si no hubo comentarios de antemano.
- Probar y pulir el modelo completo será un esfuerzo conjunto entre el cliente y yo (en el caso de Live2D rig), esto es para detectar cualquier error menor. Si el cliente no responde dentro de los 4 días desde que es notificado, se entregará sin revisiones y se cobrará un extra por cualquier comentario posterior.
- Me reservo el derecho de mostrar públicamente los proyectos encargados de la forma que desee (esto incluye, entre otros, cargar videos y hacer transmisión en vivo), en cualquier etapa, incluso cuando ya esté terminado. Si el cliente desea que una comisión se mantenga privada hasta un tiempo determinado, debe indicarlo al realizar el pedido, esto tiene un precio extra (+15%).PAGO
- Sin reembolsos. En el caso de que yo deba cancelar un pedido (sin antes haber comenzado el trabajo), el cliente será reembolsado íntegramente por cualquier trabajo no acabado. El cliente acepta no presentar una devolución de cargo sin antes contactarme.
- Todos los pagos deben realizarse a través de facturas proporcionadas por mí a través de PayPal, solo se aceptarán USD (el cliente debe realizar las conversiones de moneda). No comenzaré el proyecto hasta que 50 % del precio total del trabajo haya sido totalmente pagado por adelantado. Si eres de Chile, puedes elegir “Mach” para pagar por el proyecto (1 USD = 800 CLP).
- El primer pago debe recibirse dentro de los 10 días desde la entrega de la factura. Si no se recibe el pago, me reservo el derecho de cancelar el proyecto.
- Para el arte del modelo para Live2D, el 50 % restante se debe pagar luego de la aprobación del boceto; para el rig en Live2D, el 50 % restante se paga al completar la cabeza; y para cualquier otro proyecto, el 50% restante se realiza al aprobar el sketch. Si el proyecto contiene ambos tipos de trabajo, se pedirá el 50% del total para empezar y el 50% restante después de la aprobación de la animación final.
- Si el cliente no realiza los pagos adicionales dentro de los 12 días posteriores a la primera finalización (o cualquier etapa de finalización), me reservo el derecho de cancelar el proyecto sin reembolso.DESCARGO DE RESPONSABILIDAD
- Todas mis ventas son "Obras de arte digitales", usted compra la "Propiedad intelectual de la obra de arte".
- Nada está destinado a ser enviado físicamente al cliente.
- No me hago cargo de problemas de copyright del personaje si el cliente utiliza referencias de otros ya existentes.PROYECTO TERMINADO
- El cliente no debe reproducir ni distribuir el proyecto para ningún otro fin que no sea el uso personal (puede utilizarlo en transmisiones, contenido en Youtube o cualquier otra plataforma de transmisión). Para solicitar información sobre trabajos para uso comercial, envíeme un correo electrónico directamente a [email protected].
- El cliente debe darme créditos apropiadamente sobre el proyecto en todas las redes sociales y plataformas de transmisión donde se utilicen, puede buscar mis redes sociales en este sitio (también puede poner solo una de ellas).
- En general, los modelos no pueden ser editados o actualizados por otros riggers. Intentaré priorizar las solicitudes de los clientes existentes, pero tenga en cuenta que la disponibilidad no siempre está garantizada.
- El cliente o cualquier otra persona no debe editar, copiar, distribuir ni modificar el trabajo. Además de reclamar/acreditar el proyecto encargado como propio. PUEDES editar los colores de tu modelo con Vtube Studio.
- A la entrega final del proyecto, mantendré abierto el ticket del proyecto durante una semana para las revisiones finales, si desea revisar algo esto será a través de mensajes privados. Las solicitudes de revisión realizadas después de este período se considerarán un proyecto de "actualización" y se procesarán y programarán como tales.
- Proporcionaré créditos a las redes sociales del cliente durante y al finalizar el proyecto cuando se utilice en redes sociales.
- El cliente es responsable de guardar cualquier información dada por mí. Intento conservar la pieza final hasta 3 meses después, sin embargo, no puedo garantizarlo.
- Para las obras de arte me reservo el derecho de mantener mi firma en ellas.OTROS
- Mis horarios laborales son de Lunes a Viernes de 9:00 a 21:00 CL.
- No doy permiso para usar imágenes generadas por IA (o cualquier cosa relacionada con IA), NFT's y demás con mi arte o cualquier cosa relacionada conmigo.
- Puedo revisar estos Términos de vez en cuando y en cualquier momento cambiarlos, si estos cambios recaen en algún proyecto en curso, me pondré en contacto con usted para actualizar los términos. El cliente acepta estar sujeto a los Términos y Condiciones revisados.
